Amendment 6, which would have preserved funding for law enforcement personnel in the justice system, failed in the general election.

The amendment originated in the state Senate as a joint resolution and would have supported pension benefits of current and former sheriffs, prosecuting attorneys and circuit attorneys, according to the secretary of state's summary.

It aimed to reinstate a $3 court fee that was ruled unconstitutional in 2021.

What is Amendment 6?

Amendment 6 is a ballot measure that would have allowed "costs and fees" to be added to judicial administration to fund the "salaries and benefits" of various law enforcement and law administration officials.

The charge that funded sheriffs' pensions was deemed unconstitutional in 2021 by the Missouri Supreme Court. A passed Amendment 6 would have allowed the legislature to reinstate those fees.

Since the ruling, the sheriff pension system has been coasting on reserves — being over 100% full in 2021 and dropping steadily since.

Both opponents and supporters of the amendment have agreed the system needs funding but disagreed on the resolution.
