Republicans are asking the Pennsylvania Supreme Court to take action over some mail ballots being counted in the state.
The Republican National Committee and the Republican Party of Pennsylvania filed the application with the Pennsylvania Supreme Court on Thursday morning.
They're asking the court to exercise its King's Bench power, its extraordinary jurisdiction, to enforce that the correct date requirement on mail ballots is mandatory.
The filing requests that all Pennsylvania counties be ordered to not count misdated or undated mail ballots. Counting those ballots would violate the Pa. Supreme Court's most recent order, the GOP says.
The Republicans say some counties have decided after the election to count undated or misdated ballots, citing Bucks County as an example. David McCormick, the Republican U.S. Senate candidate in Pennsylvania who is locked in a tight race with Democratic incumbent U.S. Sen. Bob Casey, sued Bucks County on Thursday for counting the undated ballots.
Some counties are still counting ballots.
McCormick leads by less than half a percentage point, which has triggered an automatic recount under Pennsylvania state law.
